General
Under this program Private Formula International Pty Ltd ABN 16095 451 442 (“PFI”) is offering Reward Points (“Points”) and member benefits through associated program partners (“Promoter”) to those members who enrol in the Dr. LeWinn’s Rewards Program (“Rewards Program”).
Members will be allocated Points for providing proof of purchase of all individual Dr. LeWinn’s products and qualify under the terms and conditions of the Rewards Program. These Points can be redeemed in the form of merchandise, vouchers and leisure experiences, as detailed in the Dr. LeWinn’s Rewards Member Book (“Member Book”) and Rewards Website (www.drlewinnsrewards.com).
Enrolment in the program is deemed acceptance of these membership terms and conditions. These terms and conditions are correct at the time of print however the promoter and PFI reserve the right to alter them at any time without notice.
PFI shall NOT, to the extent permitted by law, be liable for any loss, damage (including direct or consequential) or injury (including personal injury) whatsoever suffered as a result of accepting and redeeming Points.
The program runs for a period of 6 months from 1st January 2009 to 30th of June 2009 unless members are otherwise advised by PFI.
PFI reserves the right to terminate the program at any time by giving members one month notice.
PFI may change the terms and conditions of the program at any time. PFI will notify members of any changes via email that may adversely affect members of the program.
The examination of any tax obligations associated with the program is entirely the responsibility of the member.
Despite any other clause in these terms and conditions, PFI reserves the right to disallow and/or terminate memberships at its discretion.
PFI reserves the right to disqualify any person from the Rewards Program if PFI believes that person has violated any of the program rules. Suspension or disqualification may result in the termination of an individual’s or company’s participation in the program and subsequent loss of all accumulated Points.
Eligibility
Retail sales staff and other selected staff of PFI trade customers (as selected by PFI management) are eligible to join the Rewards Program.
Members must be employed by a direct retail account customer (“store”) of PFI.
There is no joining fee to become a member nor are there any ongoing fees, except as specifically provided for in these terms and conditions.
Any retail staff who has been trained by PFI within the last 12 months and selling PFI products included in the promotion, is eligible to enter as long as permission is obtained from the store proprietor or the head office. To remain a member of this program, a yearly Dr. LeWinn’s Training Seminar must be attended by the participating retail staff to ensure a maximum level of product knowledge and sales training.
The Rewards Program is exclusively targeted at the individual retail sales staff. No store Rewards are granted. Resale of Rewards is strictly forbidden and non-transferable.
Points
Collection of Points
For every $200 of Dr. LeWinn’s products sold at retail value, the member earns 15 Points.
Points are accumulated by the member based on the receipt of proof of purchase (“dockets”) of nominated PFI products. All dockets have to be redeemed for Rewards or 15 Points Vouchers within 3 months of their transaction with their Area Sales Manager (ASM). Dockets older than 3 months cannot be redeemed.
Only dockets issued after the 1st January 2009 can be redeemed for Reward Points.
In order to qualify for Points, the member must sell only selected products from PFI.
Points are non-transferable and cannot be redeemed for cash and have no monetary or surrender value.
Points are only valid for 12 months after the date of issue.
Redemption of Points
Members can submit a claim for any item from the Member Book or Rewards Website through their ASM during the visit to the store. If false information is supplied, then PFI may immediately terminate the membership and the member may forfeit any Points currently held.
Redemption - General
Members can redeem their Points from 1st January 2009.
Only dockets issued after the 1st January 2009 can be redeemed for Points/Rewards.
All Rewards are subject to availability. Substitutions for a Reward of comparable value may be necessary in circumstances outside of PFI’s control. Any substitutions will be notified to the member at the time of redemption or as soon as non-availability is established.
When members redeem Points for a mixed selection of Rewards in the same order, they may expect delivery within 4-6 weeks of order, however, ordered items may arrive in separate consignments.
Along with their Dr. LeWinn’s Rewards Member Number (Member ID), members are issued with a Personal Identity Number (“PIN”) at the time of joining the Rewards Program. It is the member's responsibility to keep this member PIN confidential. In all forms of contact regarding the program, including redemption, members must disclose their member PIN to PFI and the redemption centre.
Points are allocated in the name/s of those enroled in the program. It is the member's responsibility to ensure that the redemption of Points is by authorised person/s only. PFI and the ASMs take no responsibility for Points redeemed fraudulently.
Redemption - Rewards
The Rewards of this program are available for despatch within Australia only.
The details of the Rewards as set out in the directory are based upon information provided by the supplier.
PFI is not involved in the assessment of the Rewards. Photographs found in the Member Book or on the Rewards Website may not be specific to actual merchandise received. PFI and the Promoter reserve the right to make alterations to any details without notice. All Rewards detailed within the directory are subject to change without further notice.
Private deliveries will be sent to the address nominated by the member at the time of placing the order. Delivery of Rewards will be made between 9am and 5pm, Monday to Friday by Australia Post (registered mail). The members or their authorized representative’s signature will be required on receipt of delivery. Otherwise a notification will be left in mailbox for next business day pick-up at Australia Post.
Delivery of Rewards is included in the Point value.
For courier deliveries, only one deliver attempt will be made per order. Rewards that are delivered will not be left at the nominated address unless the member or their authorized representative is there to accept and sign for the consignment. Should an additional delivery be required, any cost incurred will be at the expense of the member and will be payable at the time of delivery.
PFI or the ASM will not be responsible for damaged Rewards received unless noted at the time of delivery and advised within 3 days of delivery. Outside this 3-day period manufacturer's warranties will apply. It is the members' responsibility to complete any manufacturer warranty cards within 3 days of receipt of the Reward.
Rewards may not be returned or exchanged for cash.
If the Rewards selected are not available within 4-6 weeks of ordering, PFI will advise the member and the member may:
Accept delayed delivery time
Accept a substituted reward of similar quality
Choose a substitute reward.
Cancel the order
The member needs to notify their ASM or PFI Head Office if Reward has not been received after 4-6 weeks.
Other than in the above circumstances members are unable to cancel a Rewards redemption request. Once a Reward has been claimed, you cannot change, cancel, exchange or return Rewards to obtain a credit of the relevant Points.
All Rewards are subject to availability of stock.
Misplaced experience or movie vouchers cannot be replaced.
Rewards - General
The Member Book and Rewards Website outline the Rewards and leisure experiences available and is correct at time of publishing. PFI reserves the right to make alterations without notice.
All potential holiday packages and leisure experiences are subject to availability and block out dates may apply as shown in the Member Book or Rewards Website.
Rewards - Making a domestic travel reservation
All names of individuals travelling must be advised at time of making the reservation.
Once the member's reservation is confirmed the member will be contacted either by email, phone or fax and advised of the booking confirmation. The redemption centre will then post to the member an accommodation voucher that indicates the name in which the reservation is made, the accommodation selected and the dates chosen. The voucher will be required by the accommodation house, hotel or resort upon check in and will cover the cost of the accommodation (including GST). Vouchers are non-transferable.
Misplaced or damaged accommodation vouchers cannot be replaced.
Warranties and Liability
Except as provided in any law, which cannot lawfully be excluded or modified by agreement, PFI makes no express or implied warranty or representation in connection with the Rewards Program (including with respect to type, quality, standard or fitness for any purpose).
Descriptions of the Rewards in the Member Book/Rewards Website or other program collateral are based on information provided by the Rewards supplier/manufacturer. PFI expressly disclaims any responsibility and liability for any inaccuracy or misdescription contained therein.
PFI is not responsible if a member cannot claim or redeem a Reward for reasons beyond PFI’s control (including industrial disputes, insolvency, flood, war or civil disturbance, acts of terrorism, transport unserviceability or unavailability, or the failure of a reward supplier/manufacturer to honour its obligations under this program for any reason).

Communication
PFI will communicate with the member via email, mail and phone. Every member has the option to opt out of the general email newsletter communication. PFI maintains the right to contact the member if required.
In the event of any dispute the decision of PFI will be final. No correspondence will be entertained after that.
